Privacy and security of customer data of Most sp. z o.o. is our priority. We do care that our customers will have a feeling that they can rely on us knowing that by exercising the highest diligence we guarantee that all data and information entrusted to us will be processed only in line with its intended use and protected against misuse. Comprehensive security and broad protection of data is more than only an obligation to us, concerning observance of statutory and regulatory requirements – this is also clear evidence of quality of our services addressed to customers and staff members.

 

Cookies

The www.mostsopot.pl website uses “cookies”, which allow you to remember selected information about your users and their preferences. However, by means of them personal data is not processed or stored but only information allowing:

  1. Adapting the portal to users’ needs
  2. Creating viewing statistics for the portal’s subpages
  3. Adapting some information displayed in the portal and on partner websites to user’s interests.

A user who does not want “cookies” to be used for the purpose described above can configure settings of web browser used in a way making it impossible to store said files in computer’s/terminal device’s memory. Most sp. z o.o. fully respects the right to privacy and protection of technological data. We only collect information about the use of this portal by storing technological data such as the date of connection to the website and the IP address (type and version of the web browser, domain name, operating system used by the user) in the system logs. This information is used for administrative and statistical purposes only and does not allow Most Sp. z o.o. to identify a single user.

This data is stored in a special security zone and only authorized persons have access to it, associated with the portal: www.mostsopot.pl and obliged to keep obtained information secret. Pursuant to Article 18 section 6 of the Act of 18 July 2002 on providing services by electronic means (OJ No. 144, item 1204), Most sp. z o.o. may become obliged to provide information included in access logs (including in particular computer’s IP number) to state authorities, entitled, based on the law for the needs of proceedings conducted by them.

As an administrator of the www.mostsopot.pl website we do not bear responsibility for the policy on protection of privacy of other websites, also those available to users thanks to links placed on our portal.

Protection of personal data

In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”), we hereby inform about the principles of processing personal data by Most Sp. z o.o. and about the rights related thereto.

The controller processes the following data:

  • for the purpose of employment – to the extent required by law – the legal basis of Article 6(1)(C) of the Code of Labour in connection with Article 22(1) of the Act of 26.06.1974 Labour Code and the Regulation of the Minister of Labour and Social Policy of 28.05.1996 on the scope of keeping records by employers in matters related to the employment relationship and the manner of keeping personal records of the employee (Journal of Laws 2017).894 dated 2017.05.08) and Article 6 (1) (a) of the GDPR with regard to personal data which are not subject to the obligation to process them, provided for in legal regulations;
  • in order to conduct the recruitment process – mandatory data: first name (forenames) and surname, parents’ names, date of birth, place of residence (correspondence address), education, course of previous employment – legal basis art. 6(1)(c) GDPR in connection with art. 221 § 1, 3 of the Labour Code; for other data, their submission is voluntary and requires the candidate's consent to process personal data - legal basis art. 6 sec. 1 letter a of GDPR;
  • in order to conclude a contract, perform the service and issue an invoice, i.e. Name or company name, address, telephone number, email address, tax identification number, account number – legal basis: Article 6(1)(b), (c) GDPR in connection with the Act of 23 April 1964 – Civil Code and its implementing acts;
  • in connection with applying for, and performance of a public contract – name, surname, data concerning the rights held, e-mail address, telephone number of
    a natural person indicated by Subcontractors – legal basis: Article 6(1)(c) of GDPR;
  • for archival (evidence) purposes consisting in securing information in case of legal need to demonstrate facts resulting from legitimate interests pursued by the Controller – legal basis: Article 6(1)(f) of GDPR;
  • for the purpose of establishing, investigating or defending against claims arising from legitimate interests pursued by the Controller - legal basis: Article 6(1)(f) of GDPR;
  • in order to respond to a message addressed to the Controller via e-mail address: This email address is being protected from spambots. You need JavaScript enabled to view it. indicated on the Controller's website and through the contact form available on the Controller's website www.mostsopot.pl, to the extent of the information provided by the user, i.e. first and last name, e-mail address, telephone – the legal basis for processing is the user's voluntary consent - Article 6(1)(a) of GDPR.

The recipients of personal data processed by the Controller may be:

  • persons or entities to whom tender documentation will be made available on the basis of Article 8, Article 96(3) 3 and Article 36(1) of the Act of 29 January 2004 – Public procurement law (Journal of Laws of 2017, items 1579 and 2018);
  • other entities, if it is necessary for the implementation of the conducted cooperation, in a safe manner, and in accordance with the applicable provisions of law (courier companies, law firms, courts).

The Controller processes personal data obtained from the following sources:

  • directly from the data subject,
  • from public sources in the form of e.g. business registers: KRS, CEIDG, etc.
  • from other sources, e.g. from Subcontractors in order to properly perform the contract, or in order to meet legal requirements in case of applying for a public contract.

Providing personal data in order to conclude an agreement with the Controller, to the extent provided for by law, is necessary for employment or cooperation with the Controller and is
a precondition for concluding, performing an agreement or issuing an invoice. Failure to provide the necessary information in accordance with the law may result in the impossibility of concluding an agreement. If you apply for participation in the recruitment process, failure to provide information, in particular concerning the course of employment or education, may further prevent participation in the recruitment process.

The Controller does not use automated data processing, including profiling.

The person whose data are processed by the Controller have the following rights:

  • the right of access to personal data concerning him/her in accordance with the provisions of Article 15 of GDPR;
  • the right to rectify personal data relating to him/her in accordance with Article 16 of GDPR;
  • on the basis of Article 18 of GDPR, the right to demand from the Controller to restrict the processing of personal data, subject to the cases referred to in Article 18(2) of GDPR;
  • the right to object to the processing of personal data on the basis of Article 21 of GDPR;
  • the right to transfer personal data, in accordance with the provisions of Article 20 of GDPR;
  • the right to deletion of data in accordance with the provisions of Article 17 of GDPR;
  • the right to lodge a complaint with the President of the Office for the Protection of Personal Data, if the data subject considers that the processing of personal data concerning him or her violates the provisions of GDPR.

Where the processing of personal data is based on the voluntary consent of the user, the data subject shall have the right to withdraw consent at any time without prejudice to the lawfulness of the processing which has been carried out on the basis of consent prior to its withdrawal.

Personal data will be processed for the period necessary to achieve the purpose of processing, and after that time for the period and to the extent required by the provisions of generally applicable law.

Applications of candidates participating in the recruitment process shall be kept for a period not longer than 90 days counted from the last day of the job advertisement issue. If the candidate agrees to participate in future recruitments, the period of processing personal data for further recruitment is set at 3 years. After these periods, paper and electronic applications are destroyed.

 

Video surveillance

We would like to inform you that video surveillance is used at Most Spółka z o.o.

A person entering the Controller's premises consents to the processing of data. Lack of consent to the processing of data will result in refusal of access to the company's premises.

The legal basis for processing the data (image) obtained in the process of video recording is the Controller’s legitimate interest – ensuring the security of persons and property located on the Controller's premises, including the Controller's employees, customers and guests (Article 6(1)(f) of GDPR.

The surveillance covers the Controller's area around the Company's Office, including a car park and areas of the project implemented by the Controller. The surveillance is announced through visible plates before entering the Controller's premises.

On the premises of the Company's Office in Gdynia there is also a video intercom, which enables a current preview of the image of a person entering the Controller's premises and the Controller's office building – the preview is not recorded in any form nor stored (the Controller informs about the video intercom used by marking the device before entering the Controller's premises).

Video surveillance is not an element of control over the performance of work by persons employed by the Controller.

Personal data collected through video surveillance may be made available to entities authorised under the provisions of law, i.e. law enforcement authorities within the framework of conducted proceedings.

Surveillance recordings will be stored for a maximum period of 3 months and are automatically overwritten. In the event that the recordings may constitute evidence in court proceedings, the time limit for keeping the recording may be extended until the proceedings are effectively terminated.

A person whose image has been recorded through surveillance shall have the right to access the recording, provided that the rights and freedoms of third parties are not affected.

A person registered by the surveillance system has the right to request the Controller to correct the data, delete, limit the processing and object to the processing.

A person registered by the surveillance system has the right to lodge a complaint with the supervisory authority that is: President of the Office for Personal Data Protection, in case of ascertaining that there has been a violation of the law with regard to the processing of personal data transferred.
